(Teacher Digital Toolkit).

The following provides clarifications to frequently asked questions regarding the Thaki Agreement and Waiver Form.

      Are Thaki Laptops new?

Thaki uses this opportunity to remind recipients of Thaki laptops that these laptops are not new. They have been generously donated to Thaki primarily through corporate donations or Thaki has purchased them. These laptops are second-hand, in good condition, functional, and still have many more years of service in them. Thaki uploads educational content on these laptops and then distributes them to learning centers working with refugee or marginalized children. The reduction of e-waste is core to Thaki’s mission and its circular economy model.

Whose responsibility is it if the laptops break down or require replacement of parts?

Prior to handing over laptops to any recipient organization, Thaki conducts its due diligence and ensures that the laptops are functional and in good working condition. Laptops are cleaned of any prior content. Once the laptops are handed over to the recipient organization, Thaki requests that the recipient organization check the laptops before signing the Agreement and Waiver form. If a laptop is found to be non-functional or problematic, Thaki will try to replace it. However, once the Agreement and Waiver form is signed and the official handover completed, the laptops become the property of the recipient organizations. As such, any subsequent maintenance of the laptops becomes the responsibility of the recipient organizations. The laptops do not come with a warranty.

What is expected of the recipient organization once they have received the Thaki laptops?

The laptops become the property of the recipient organizations to implement Thaki educational programs as they see appropriate. Thaki only conducts an annual survey to gather data on how the laptops are being used so as to improve its program.

For the annual surveys, what data is Thaki interested in so that we (as implementing partners) can start to collect them?

Thaki sends out three types of surveys on an annual basis. This is usually scheduled for the end of May or early June. One survey is to be filled out by the school’s administrator (i..e Partner Survey), the second by the teachers (i.e. Teacher Survey), and the third by students (i.e. Student Survey). The surveys are designed to be light and not time consuming. Thaki follows a “purposive sampling” methodology whereby a small number of students are selected to complete the survey. The number of students chosen from each school depends on the total number of students at the respective school.  This reduces the actual number of surveys to be completed. The type of data Thaki collects per type of survey is as follows:

          • Partner Survey:

Section One: General information relating to the organization such as name, type, sector, year of establishment, location, focal point, and date they started working with Thaki.

          Section Two:

          1. Questions on the role of the person filling out the survey, number and location of centers they operate, grade levels that are served, number and age range of the students, gender breakdown of students, and demographics of students.
          2. Questions on the overall number of teachers at the school, number of teachers that utilize Thaki laptops, overall number of Thaki laptops received by school, how are Thaki laptops typically used by teachers and students, number of laptops which are no longer working, and what do they do with laptops that no longer work,
          3. Questions on the number of students that utilize Thaki laptops, number of hours a week that each child works on a laptop/computer, and number of students per laptop.
          4. Questions regarding the school’s need for more laptops, are they considering procuring more Thaki laptops or from another source, and does the school have other hardware needs.
          5. Questions regarding additional educational resources the schools would like to see on the Thaki laptop and what additional feedback they may have.
          • Teacher Survey:
          1. Section One: General information about the teacher.
          2. Section Two: Questions on the  grade level that they teach, subjects that they teach, number of classes they teach, number of children in the classroom that use Thaki computers, how the teacher utilizes the Thaki laptops, and  number of hours you use the laptop on average per week.
          3. Section Three: Questions regarding the teachers technical skills and computer literacy.
          4. Section Four: Questions on the educational content on the Thaki laptop.
          5. Section Five: Questions on usage and benefit of computer/laptops on students.
          6. Section Six: Feedback on Nour’s World
          7. Section Seven: Feedback on the Teachers Digital Toolkit (TDT).
          8. Section Eight: Questions regarding the programs the teacher uses on the Thaki laptop.
          • Student Survey:
          1. Section One: Questions on student profile (name, age, grade).
          2. Section Two: Questions on students’ familiarity with laptops.
          3. Section Three: Questions on the student’s technical and software skills.
          4. Section Four: Questions on student’s perceptions of Thaki laptops.
          5. Section Five: Questions evaluating the educational programs on the Thaki laptop.
          6. Section Six: Questions evaluating the impact of Thaki’s content.
          7. Section Seven: Questions regarding the programs the student uses on the Thaki laptop.
What is the nominal fee organizations are expected to pay?

Thaki charges a nominal fee, as part of its business model, to recipients for the devices they receive from Thaki. This fee, however, is not based or tied to the content that is on the devices, but rather to the specifications of the donated laptops. Typically, the higher the specs, the higher the nominal fee an organization pays. Please note this fee is a margin of what a laptop of similar specifications would cost commercially.

How does Thaki determine the “in-kind” value and how does that impact my organization?

In-Kind value includes the value of the donated laptops and the value of the educational content provided on the Thaki laptop as follows:

          – Hardware. Second hand donated or purchased laptops are valued by doing a search on platforms such as e-Bay (an internationally recognized  online reseller of used goods by the general public), and finding the same or comparable specs for the device in question and assigning a low-conservative value based on the noted values.

          – Educational Content. Thaki computers are loaded with both open source as well as proprietary educational content and software. Thaki does track and place a value on the proprietary content, but not for the open source content. The value of the content is either provided directly by the content provider, or is derived from publicly available information. In the case of the former, the in-kind value reflects what the educational content provider would normally charge consumers for the right to use this content in comparable markets. For annual subscription based content, it is assumed that Thaki devices will have a 3-year lifespan, which means that the value of the content over three years is calculated.

How does the“in-kind” value impact my organization?

The “in-kind” value is intended to illustrate the value of the hardware and educational content your organization is receiving upon becoming a recipient of Thaki laptops. There is no obligation or reimbursement expected from recipient organizations.

The agreement states that for any disputes, the laws of the Netherlands apply. Why is that and can it be changed?

Thaki is registered in the Netherlands and it is for this reason that the Waiver form stipulates that for any disputes, the laws of the Netherlands apply. To date, this clause has never been enacted thankfully.

Under the section “ DISCHARGE AND WAIVER OF LIABILITY”, the Agreement language is concerning, especially as we work with young children.

This type of waiver is a standard legal requirement that is included to protect organizations like Thaki when providing donated or used equipment. It is similar to the terms and conditions you agree to when buying medicine, electronics, or any other product. The purpose of this language is simply to clarify that you understand and accept any risks involved with using donated devices, and that Thaki cannot be held responsible for any issues that may arise. This is a common practice and is not meant to alarm you—it is just a necessary step to ensure everyone is aware of their responsibilities.
